　　一、涉外刑事辩护业务发展背景

　　随着经济全球化的不断发展和“一带一路”建设的不断推进，来华的外国人以及走出去的国人数量持续增加，犯罪问题也开始呈现出全球化的趋势。党的二十大报告提出，“加强重点领域、新兴领域、涉外领域立法，统筹推进国内法治和涉外法治”。[1]

　　从目前国家和各省、自治区开展的涉外法治建设活动来看，活动主要力量集中在涉外民商事领域，但涉外刑事业务的重要性不可忽视，刑事业务关乎当事人的人身自由、财产安全、乃至生命，涉外刑事案件可能引起国家间的特别关注，这些因素都对办理涉外刑事业务的律师提出了更高的要求，涉外刑事辩护律师不仅应专业过硬，具有丰富的办案经验，更应该具有国际视角和政治敏感性。

　　二、涉外刑事业务概况

　　涉外刑事业务总量虽然不大，但近年来也呈现出一定的增长之势。根据公开资料显示，在全国范围内，2018年至2022年检察院办理涉外刑事案件2万余件、刑事司法协助案件885件。”[2]在北京市范围内，2016年外国人实施刑事犯罪总共237件，治安管理案件200件[3]，2018—2022年北京市范围内的检察院共办理涉外案件574件。[4]

　　涉外刑事案件通常是指具有一定涉外因素的刑事案件，如当事人为外国人或无国籍人、犯罪行为地或结果地为他国领域的刑事案件。根据中国有关法律法规等的规定，常见涉外刑事案件进一步分为：

　　（一）在中华人民共和国领域内的，外国人犯罪或者我国公民针对外国人犯罪的案件；

　　（二）在中华人民共和国领域外的，我国公民犯罪的案件；

　　（三）在中华人民共和国领域外的，外国人针对我国国家或者公民犯罪的案件；

　　（四）外国人跨越两个以上国家实施的犯罪，其中犯罪行为地或结果地中的至少有一个处于我国领域内的案件；

　　（五）我国基于已缔结、加入的国际条约或协定，对外国人在中华人民共和国领域外犯罪应当管辖的案件。

　　此外，涉外刑事案件还可能包括境外追赃追逃、境外取证等需要通过司法机关开展刑事司法协助的案件和情势。

　　上述案件和情势由于主要适用中国法律，需要由具有相关办案经验的中国律师来提供法律服务。

　　I.Background of the Foreign-related Criminal Cases Development

　　The globalization of the economy and the advancement of the"Belt and Road Initiative"have led to an increase in foreigners coming to China and Chinese citizens traveling abroad,resulting in a growing trend of globalization in criminal issues.The 20th National Congress of the Party emphasized the need to strengthen legislation in foreign-related fields,aligning with domestic affairs to create favorable legal conditions for development and governance.[5]

　　From the perspective of the current foreign-related legal construction activities carried out by the country and various provinces and autonomous regions,the main activities are concentrated in the field of foreign-related civil and commercial matters.However,the importance of foreign-related criminal practice cannot be ignored,as criminal matters involve personal freedom,property security,and even life.Besides,foreign-related criminal cases may attract special attention between nations.All the factors mentioned above put forward higher requirements for lawyers handling foreign-related criminal matters.Foreign-related criminal defense lawyers should not only be professionally competent with rich practical experience but also possess an international perspective and political sensitivity.

　　II.Overview of Foreign-related Criminal Defense Practice

　　While the total volume of foreign-related criminal cases may not be extensive,recent years have witnessed a steady increase.Procuratorates across the country,from 2018 to 2022,handled over 20,000 foreign-related criminal cases and 885 cases of criminal judicial assistance.[6]In Beijing alone,there were 237 criminal cases and 200 cases of public security management involving foreigners in 2016.[7]From 2018 to 2022,the procuratorate in Beijing handled a total of 574 foreign-related cases.[8]

　　Foreign-related criminal cases typically refer to criminal cases with certain foreign-related factors,such as criminal cases in which the accused are foreigners or stateless persons,and the place or result of crimes committed by Chinese citizens is in the territory of another country.According to relevant Chinese laws and regulations,common foreign-related criminal cases are further divided into:

　　1.Cases involving crimes committed by foreigners or crimes committed by Chinese citizens against foreigners within the territory of China;

　　2.Cases involving crimes committed by Chinese citizens outside the territory of China;

　　3.Cases involving foreigners committing crimes against our country or citizens outside the territory of China;

　　4.Cases involving crimes by foreigners across two or more countries,in which at least one of the places where the crime is committed,or the result is located within the territory of China;

　　5.Cases in which China has jurisdiction over crimes committed by foreigners outside the territory of China on the basis of international treaties or agreements concluded or acceded to by China.

　　In addition,foreign-related criminal cases may also include situations that require judicial authorities to conduct criminal judicial assistance,such as overseas asset recovery,extradition,and overseas evidence collection,etc..

　　Given that these cases fall under Chinese jurisdiction,they require the expertise of Chinese lawyers well-versed in relevant laws and experienced in handling such cases.
